Terms and Conditions
TERM 1
Once we receive your completed booking form via our online booking and deposit, your holiday will be reserved for you and your party. Your booking is confirmed and accepted in respect of all persons travelling when we forward our invoice to the person signing the booking form.
TERM 2The deposit is £400.00 per week to be received within seven days of receiving your invoice. The balance is required no later than 10 weeks before your booking date. If a booking is placed 10 weeks prior to your arrival date the total cost of your holiday must be paid in full and sent with all other necessary documents.
TERM 3
A damage/breakages deposit of £250.00 is to be paid at the time of final payment, the BACS payment will be returned seven days after your holiday ends provided you and your party have left the property/lake/grounds in the same condition as when the holiday started. This does not limit the client’s liability to the owner. The client shall report to the bailiff/caretaker without delay any broken or missing items, defects or breakdowns at the start of their holiday. The client shall reimburse the owner for any damage/breakdown of the property contents and equipment in the grounds including that caused by negligence by anyone in their party.
TERM 4
If full payment is not received 10 weeks prior to the arrival date, EMV Fisheries ltd reserve the right to cancel your booking: payments may not be refunded and a cancellation fee incurred.
TERM 5
If however you cancel your confirmed booking, it will only be accepted in writing via email, signed by the Group Organiser and the following charges will apply:
- Cancellation 10 weeks or more before travel date cancellation fee = deposit only
- Cancellation 5 – 10 weeks before travel date cancellation fee = 50% of the total cost
- Cancellation less than 5 weeks before travel date cancellation fee = full cost of the holiday.
TERM 6
Travel arrangements/requirements are your responsibility and we accept no responsibility for delays or cancellations in ferries or, if there are irregularities in your documents. The client is advised to have comprehensive travel insurance to include cancellation cover, personal effects, medical cover and public liability since these are not covered by us.
TERM 7
Force Majeure: We will not be held liable for loss or delay occasioned by any of the following: Strikes, Political Unrest, Riots, Port Closures, War or Threat of, Terrorist Activity, Industrial Disputes, Fire, Flood, Technical / Weather problems to transportation, Acts of God or any other event(s) beyond our control.
TERM 8
If changes to the confirmed booking are required, we will try and be flexible wherever possible.
TERM 9
All children under the age of 16 must be accompanied by an adult.
TERM 10
We are not liable for any temporary defect or stoppage of public services to the property in respect of any equipment or appliances in the property, nor any loss, damage or injury as a result of adverse weather or any other matter however caused.
TERM 11
Under no circumstances shall the owner’s liability exceed the amount paid for the rental, if in the event or substantial damage to the property before the start of your holiday we will refund all sums paid.
TERM 12
Jurisdiction: Signature on the booking form constitutes acceptance of a contract on these terms subject to English law and the exclusive jurisdiction of the English courts.
TERM 13
We reserve the right to terminate your holiday if you are in any way causing damage to the grounds, lakes or property. You will not be liable to a refund/compensation and you may incur costs for any damage carried out.
TERM 14
The person signing the booking form should have read and accepted these terms and conditions. Deposits are accepted on the strict undertaking that this action has been taken.
